If you are interested in adopting a child or children, you should contact your local authority first to make preliminary enquiries. We are then here to guide you through the process, advising you on your legal rights and ensuring that the best result is gained.
The most important requirements for adoption are that the adopter must be over 21 years of age, the child to be adopted must be under the age of 18 and that joint applications to adopt can only be made by married couples and civil partners. (Unmarried couples can adopt, but only one person can become the adopter.)
If the adoption has not been carried out through an agency, it is necessary to inform the local council of the intention to adopt a child three months before placing the application with the court. The next stage is to issue proceedings. Adoption is dealt with confidentially by the court and, unless it is defended, is usually straightforward.
Adoption from abroad is also possible but it is expensive because as well as the normal costs of adoption and any costs associated with complying with the law in the country you adopt from, a home study report is required which will cost several thousand pounds. It is important that you comply with all the proper procedures as otherwise not only will you be unable to adopt the child but you could be breaking the law.
At our office in Skegness, one of our solicitors or legal executives will talk you through the process in more detail, ensuring you are made fully aware of all the steps as well as your legal rights and obligations. |
