However, in certain situations, the issue of contact may become a source of disagreement between the parent caring day to day for the child and the parent who has moved away. When it does, parents may find that if they cannot agree contact themselves, a solicitor or mediator may help them to do so. It is very important following the breakdown of a relationship that consideration is given to the child seeing the parent with whom they are not living. This is known as contact but is still sometime referred to as access.
There may be rare cases where it is not appropriate for a child to see the other parent for instance if there has been serious domestic violence or the child is likely to suffer harm. We can advise you regarding this.
In most cases difficulties are not over whether contact should happen but where, when and how often. All children are different as are all parties circumstances. We can help however firstly by giving you impartial advice and then by negotiating with the other party on your behalf, referring you to and advising you during mediation and representing you at court.
We know the importance of trying to resolve matters regarding children amicably, after all, you and your former partner may have to communicate about them for many years. We also understand the importance of acting firmly and quickly to preserve you relationship with the children. Your children will always be at the centre of all our advice and action.
If all else fails, the only option open to the parents may be to apply to the Court for a Contact Order.
If the parent with day to day care of the child fails to comply with a Contact Order then the other parent has the option of making an application to the Court for a Penal Notice to be attached to the Order. If a Penal Notice is attached and the Order still ignored the parent who has failed to comply will be issued with a suitable punishment, possibly a fine or in extreme cases, a prison sentence.
