Alternatively, if you do not wish to divorce for social or religious reasons we are able to advise you in relation to judicial separation proceedings. This will ensure that your rights in relation to children and finances are protected whilst still remaining married.
There is only one ground for divorce in England and Wales and this is that the marriage has irretrievably broken down. This must however be supported by one of what is known as the “five facts”. In addition you must have been married a year.
The five facts are:
1. Your husband or wife has committed adultery and as a result of that you find them intolerable to live with.
2. Your husband or wife has behaved in such a way that you cannot reasonably be expected to live with them.
3. Your husband or wife has deserted you for two years. (Divorce rarely takes place on this basis.)
4. You and your husband or wife have lived apart for a period of at least two years and your husband or wife consents to the divorce.
5. You and your husband or wife have lived apart for a period of at least five years.
Divorces are rarely defended and provided they are not then your divorce will happen without you having to go to the court building at all. You will only have to go to court if you and your husband or wife have a dispute over money or your children. It may still not be necessary to go to court as we can refer you to mediation.
