It is of course not the same as divorce, you can’t remarry and you must be in agreement to make one.
Marital separation agreements can contain anything both parties wish, however they will usually include the following: -
1) A statement that the parties intend to live apart from one another.
2) What is going to happen to the property where the couple live.
3) How the assets will be divided.
4) Who will be responsible for paying the outgoings on the property whilst arrangements are being put into place.
5) Other financial arrangements.
6) How the contents of the property will be divided.
7) How the debts will be divided.
8) Financial arrangements for children involved.
9) Residence and contact for any children involved.
10) When divorce proceedings will take place and who will pay the costs.
If the couple are in agreement and both parties have independent legal advice then it can be dealt with very quickly, it will of course be longer if any negotiating needs to take place.
